Introduction
Please read these Terms of Use ("Terms") carefully. By downloading, accessing, or using the Cam One Android application (the "App"), you agree to be bound by these Terms. If you do not agree, do not use the App. These Terms are a legal agreement between you and Cam One Limited ("Company", "we", "us"). A separate Privacy Policy explains how we collect, use, and share personal information.
1. Who can use Cam One and plan eligibility
1.1 Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use the App. If you are under the age of 13, you must have your parent or legal guardian’s permission. You must be legally permitted to use the App and enter into these Terms.
1.2 Definitions
For the purpose of these Terms:
“Device” means a physical device on which the App is installed.
“Installation” means an instance of the App installed on a Device.
“Pro” means a standard subscription tier intended for single-operator, direct-to-audience streaming.
“Pro+” means an enterprise subscription tier intended for organisations and commercial-scale usage, including centralised production workflows and multi-operator use.
“Enterprise Use” means any use of the App that involves one or more of the following:

managing multiple operators, multiple Devices, multiple venues, or multiple concurrent streams under one organisation or workflow,
-
using a centralised production workflow (including any production hub, Master Control Room (MCR), broadcast truck, or central broadcast software stack) to ingest, aggregate, manage, control, or redistribute streams from multiple operators or venues,
-
providing streaming or production services to third parties as a managed service at scale (for example, running streams for multiple separate clubs or clients as part of a business), or
-
commercial redistribution, syndication, or downstream distribution of App output to third parties or commercial channels (including broadcast television networks or paid media services).
“Direct-to-audience streaming” means streaming from the App directly to end-user platforms (for example YouTube or Facebook) for viewing by the public or your intended audience, without centralised aggregation or commercial redistribution.
Clarification: A club, school, team, or league using Pro for a single-operator, direct-to-audience stream of its own matches or events (without centralised aggregation or multi-venue operations) is not, by itself, Enterprise Use.
1.3 Plan eligibility and restrictions

Pro is designed for single-operator, direct-to-audience streaming.

Pro+ is required for Enterprise Use.

Use of Pro for Enterprise Use is a material breach of these Terms.
2. Third-party services, security, and privacy
2.1 Third-party services
The App enables you to authenticate and publish streams to third-party platforms (for example, Facebook and YouTube). Your use of those platforms is governed by their respective terms and policies. You are responsible for complying with them.
If you connect a Google or YouTube account, the App may use YouTube API services. You can revoke the App’s access via your Google security settings. If access is revoked, streaming features that rely on that connection may stop working until you reconnect.
2.2 Security
You are responsible for maintaining the security of your Device and any third-party platform credentials used with the App. Notify the relevant platform and us immediately if you suspect unauthorised access.
2.3 Privacy and data requests
Our Privacy Policy explains how we collect and use personal information. If you wish to request deletion of personal data we hold, contact us at hello@camone.app. Because we do not require login, we may ask you for information that helps us locate your data (for example, Google Play order number, public stream URLs, and approximate dates and times).
3. Your content and rights you grant us
You own your content. Except for the licence below, these Terms do not transfer any ownership of your live stream content to us.
To operate the App and provide its features, you grant us a worldwide, non-exclusive, royalty-free licence to host, transmit, and display your live streams and related metadata to provide the App’s functionality (for example, preparing the stream for distribution to your chosen platforms, showing thumbnails, logging status, and troubleshooting).
You represent that you have all rights, licences, and permissions necessary to live stream the content you broadcast using the App.
4. Our use of public live stream content (unique to Cam One)
When you publish a public live stream, we may log its public URL (for example, the YouTube or Facebook watch link) in our systems for analytics and service quality.
We may use publicly available live stream content (including screenshots, titles, viewing numbers, and short clips available publicly from your public streams) for our own marketing and promotional purposes, including on our website, social channels, partner sites, and in product materials.
5. Fair usage, commercial use, and plan enforcement
We aim to provide generous, flexible use without hard limits. However, we reserve the right to take reasonable steps to protect the performance and integrity of the App and our business model.
5.1 Pro plan limitation: no centralised hub workflows or commercial redistribution
Pro is licensed for direct-to-audience streaming by a single operator. You agree not to use Pro (or any collection of Pro subscriptions) to:

ingest, aggregate, manage, control, or redistribute streams through any centralised production workflow (including a production hub, MCR, broadcast truck, or third-party broadcast software stack) where multiple operators, venues, or concurrent streams are managed centrally,

distribute App output to commercial channels, broadcast networks, or paid media services, or
-
provide the App or its output as a managed service to third parties at scale (for example, running streams for multiple separate clubs or clients as part of a business), where such use requires Pro+ or a separate enterprise agreement.
5.2 Abuse
If we determine, in our reasonable judgment, that usage is abusive, excessively burdensome to the service, or inconsistent with normal, good-faith use, we may throttle, suspend, or restrict access. We will try to notify you where practicable.
5.3 Upgrade requirement, notice, and cure
If we reasonably determine your use constitutes Enterprise Use, we may require you to upgrade to Pro+ (or enter an enterprise agreement).
Except where we believe there is urgent risk (for example, illegal activity, serious privacy breach, security risk, or service abuse), we will provide notice and a reasonable opportunity to cure before restricting features or access. A typical cure period is 10 business days.
6. Appropriate content, privacy, and lawful use (unique to Cam One)

Permissions and rights: Do not live stream content without the necessary permissions from all relevant rights-holders, venues, leagues, participants, and any other parties who may have rights in the content.

Privacy and consent: Do not live stream people in circumstances where they have a reasonable expectation of privacy, including changing rooms, bathrooms, medical areas, or private residences without permission. If minors are featured, you are responsible for obtaining any required permissions and consents.

No covert recording or surveillance: Do not use the App for hidden camera use, covert monitoring, stalking, or any surveillance purpose.

Suitable for all ages: Do not use the App to stream adult, pornographic, or otherwise age-restricted content.

Illegal and harmful content: Do not stream illegal activities, hate speech, harassment, threats, or content that infringes third-party rights.

Location and safety: Follow local laws and venue rules. Do not endanger yourself or others while filming.
Reporting: If you believe the App is being used to stream illegal or privacy-invasive content, contact hello@camone.app. We may restrict access while we investigate.
7. User submissions and feedback
If you submit feedback, ideas, feature requests, or suggestions to us, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, adapt, publish, and incorporate that feedback into our products and services without compensation to you.
8. Prohibited conduct
You agree not to:

Circumvent plan restrictions: attempt to bypass, defeat, or avoid plan limits or licensing requirements (including Pro+ requirements).

Licence stacking and centralisation: coordinate multiple Pro subscriptions to replicate Pro+ functionality or enable Enterprise Use.

Unauthorised aggregation: ingest or manage multiple Pro streams via a centralised production workflow to avoid enterprise licensing.

Commercial repurposing or data harvesting: scrape, harvest, repurpose, or commercially exploit any App content, directories, metadata, thumbnails, or analytics made available through Cam One, except as permitted by us in writing.

Access or use the App in a way that could damage, disable, overburden, or impair our systems.

Circumvent, disable, or interfere with security-related features.

Reverse engineer the App except to the extent permitted by law.

Use bots or automated means to initiate or manage streams without our permission.

Misrepresent your identity or affiliation, or impersonate others.
9. Intellectual property and watermark integrity
The App and its branding are owned by the Company. You receive a limited, non-transferable, revocable licence to use the App in accordance with these Terms.
Where the App output displays a Cam One watermark (including on Pro streams), you agree not to crop, obscure, mask, blur, cover, replace, or otherwise attempt to remove or alter the watermark, including via downstream processing or external production tools. Removal or replacement of the watermark requires Pro+ or a separate whitelabel or enterprise licence.
10. Subscriptions, billing, cancellation, and refunds
10.1 Subscription management and cancellation
If you purchase a subscription, you are responsible for managing it, including cancellation, renewals, and avoiding duplicate subscriptions. Subscriptions are typically managed through the platform you purchased from (for example, Google Play). Deleting the App does not automatically cancel your subscription.
10.2 Multiple subscriptions
If you purchase multiple subscriptions (including duplicate subscriptions), you are responsible for those purchases. To the maximum extent permitted by law, we do not provide refunds for duplicate subscriptions after activation of the service, except where there is a verified technical malfunction attributable to us.
10.3 Refund request window
If you believe you were charged due to an unintended duplicate subscription or renewal, notify us within 30 days of the charge, subject to any non-excludable rights you may have and any applicable platform policies.
11. Service changes
We may update or discontinue features of the App at any time. Where changes materially affect your use of the App, we will make reasonable efforts to provide notice.
12. Termination and restrictions
We may suspend, restrict, or terminate your ability to use the App if you materially breach these Terms or as permitted under the Fair usage section above.
Because we do not require login, restrictions may be applied to an Installation, a Device, or other technical identifiers associated with usage.
13. Disclaimers
We do not control third-party platforms. We make no guarantees that your streams will be accessible on those platforms without interruption. The App is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law.
14. Limitation of liability
To the fullest extent permitted by law, the Company and its affiliates will not be liable for indirect, incidental, special, consequential, or exemplary damages, or for lost profits, revenues, or data. Our aggregate liability will not exceed the amounts you paid to us (if any) for the App in the 12 months before the claim.
15. Indemnification
You agree to indemnify and hold the Company harmless from claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the App, or your streamed content.
16. Updates to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date above. If a change is material, we will provide reasonable notice. Continued use after the effective date constitutes acceptance.
17. Governing law
These Terms are governed by the laws of New Zealand. You consent to the exclusive jurisdiction of the courts located in New Zealand for disputes.
